Welcome to M&AK's Kitchen. These Terms of Service (the "Terms") govern your use of mandakskitchen.com (the "Site") and any purchases you make from us. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.
1. Who can use the Site
You must be at least 18 years old, or have permission from a parent or legal guardian, to make purchases through the Site. By placing an order, you confirm that the information you provide is accurate and that you have the legal capacity to enter into this agreement.
2. Accounts
You can shop with us as a guest or create an account at checkout. Accounts let you track orders, save addresses, and manage future purchases more easily. If you create an account, you're responsible for keeping your login credentials secure and for any activity under your account. Please notify us right away if you suspect unauthorized use.
3. Our products
We sell ready-to-cook West African sauces and related food products. We do our best to describe each product accurately, including ingredients, spice level, net weight, and intended use. Colors, textures, and packaging may vary slightly from photographs.
4. Food safety, allergens, and dietary information
Our products are made in a facility that handles common food allergens. While we take care to keep ingredients clearly labeled and follow safe food handling practices, we cannot guarantee that any product is free from trace cross-contact. Always read the label before consuming any product, especially if you have allergies, intolerances, or other dietary restrictions. Our products are not intended as medical or nutritional advice. If you have a medical condition, please consult a qualified healthcare provider.
5. Pricing and payment
Prices are listed in US dollars and are subject to change without notice. Applicable taxes and shipping costs are calculated at checkout. Payment is due at the time the order is placed and is processed through our payment provider.
We reserve the right to refuse or cancel any order, including for reasons such as product unavailability, pricing or description errors, suspected fraud, or violation of these Terms. If we cancel an order after payment has been processed, we will issue a full refund.
6. Shipping and returns
Our Shipping Policy and Refund Policy are incorporated into these Terms. Please review them before placing an order. They explain how we handle delivery, damaged shipments, lost packages, and refunds.
7. Subscriptions
We plan to offer subscription products in the future. When subscriptions launch, additional terms will apply, including details about billing frequency, cancellation, skipping shipments, and changes to your plan. Those terms will be presented at the point of subscribing and will form part of these Terms.
8. Reviews and user-submitted content
We welcome honest reviews and feedback. If you submit a review, comment, photo, or other content to the Site, you grant M&AK's Kitchen a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with our business, including in marketing materials. You confirm that the content is your own, does not violate anyone else's rights, and is not unlawful, defamatory, or offensive. We reserve the right to remove or decline to publish any content at our discretion.
9. Intellectual property
The M&AK's Kitchen name, logo, branding, photography, recipes, written content, and all other materials on the Site are owned by us or our licensors and are protected by US and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any of this content without our prior written permission.
10. Acceptable use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Site or its systems
- Interfere with or disrupt the Site's operation
- Submit false information, including false addresses or payment details
- Use the Site to harass, defame, or harm others
- Scrape, copy, or use our content for competing commercial purposes
We may suspend or terminate your access to the Site if you violate these Terms.
11. Disclaimers
The Site and our products are provided "as is" and "as available." We make no warranties, express or implied, beyond those required by law. We do not guarantee that the Site will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability and fitness for a particular purpose.
12. Limitation of liability
To the fullest extent permitted by applicable law, M&AK's Kitchen, its owners, employees, and affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Site or our products. Our total liability for any claim related to a product is limited to the amount you paid for that product.
Nothing in these Terms limits liability for matters that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless M&AK's Kitchen, its owners, and its affiliates from any claims, damages, or expenses, including reasonable attorneys' fees, arising from your use of the Site, your violation of these Terms, or your violation of any rights of another party.
14. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
15. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect. These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, form the entire agreement between you and M&AK's Kitchen regarding your use of the Site.
16. Changes to these Terms
We may update these Terms from time to time. The current version is always posted at mandakskitchen.com. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
